Charlotte Harbor Contest Official Rules
This promotional sweepstakes (the “Sweepstakes”) is sponsored by Charlotte Harbor Visitor & Convention Bureau (the “Sponsor”), in which one (1) winner is selected to receive the featured prize package. The winner will be selected by June 30, 2010.
The Sweepstakes is subject to all federal, state and local laws. Void where prohibited by law. The Sponsor reserves the right to modify the Official Rules of this Sweepstakes in any way or at any time.
WHEN AND HOW TO ENTER
ELIGIBILITY
All entrants must be at least twenty-one (21) years of age or older. Employees of the Sponsor, its advertising agencies and/or promotional partners and members of their immediate families (defined as parents, children, siblings, partner and husband or wife) together with those with whom such employees are domiciled are not eligible to enter.
WHEN TO ENTER
Sweepstakes begins at 6 p.m. (ET) on May 22, 2010, and ends at 6 p.m. (ET) on June 22, 2010 (“Sweepstakes Period”). The deadline for receipt of entry is 4 p.m. (ET) on June 22, 2010.
HOW TO ENTER
NO PURCHASE NECESSARY TO ENTER OR CLAIM PRIZE AND MUST BE 21 YEARS OR OLDER.
To enter, follow instructions published on the Sweepstakes page, complete survey and click Submit on the online Sweepstakes entry form.
The use of a false name or e-mail address will disqualify an entrant. There is a limit of one (1) entry per e-mail address and/or per person. Any duplicate entries, after the first entry, will be void. By entering the Sweepstakes, entrant consents to receiving additional Charlotte Harbor VCB information, unless opt-out is selected. All entrants agree to abide by these Official Rules. All entries become the property of the Sponsor. In the event of a dispute, the "entrant" for e-mail entries is the person in whose name the e-mail account is held.
INTERNET/TECHNICAL FAILURES
The Sponsor is not responsible for incomplete, misdirected or mutilated e-mail or for failed, partial or garbled computer transmissions. If for any reason the online entry Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Sponsor, or if any such circumstance or event corrupts or adversely affects the administration, security, fairness, integrity or proper conduct of the Sweepstakes, the Sponsor may, at its sole discretion, cancel or suspend the Sweepstakes. If the Sweepstakes is canceled or suspended for any reason, prizes may be awarded based on entries received prior to date of cancellation or during any period that the Sweepstakes is not suspended. The Sponsor, any other sweepstakes sponsor or their respective affiliates, agents, officials or employees shall not be responsible for any hardware or software failures of any kind, lost or unavailable network connection or failed, incomplete, garbled or delayed computer transmission or any human error that may occur in the receipt or processing of entries. Proof of sending will not be deemed to be proof of receipt by the Sponsor.
PRIZE PACKAGE
PRIZE
Prize may NOT be redeemed for cash or substituted. Individual restrictions may apply to each item contained in the prize package. Prize will NOT be replaced if lost or stolen. Winner is responsible for paying all applicable federal, state and local taxes and gratuities on accepted prizes.
The following prizes will be awarded:
One (1) Grand Prize package will include a 5-day, 4-night getaway for 4 with hotel accommodations at Fishermen’s Village Waterfront Mall, Resort and Marina; a King Fisher Fleet Cruise to Cabbage Key; Charlotte Stone Crabs Baseball tickets and a 2-hour kayak rental courtesy of Grande Tours.
ODDS OF WINNING
Odds of winning depend on the number of eligible entries received.
HOW AND WHEN WINNERS WILL BE SELECTED AND NOTIFIED
SWEEPSTAKES WINNERS
One winner will be selected by a random drawing from all eligible online entries received by 4 p.m. (ET) on June 22, 2010. The administration of the Sweepstakes and the drawing will be overseen by Charlotte Harbor CVB, whose decisions are final and binding in all respects related to the administration of the Sweepstakes and the selection of potential winners. Winners must be able to claim and make use of their prize by October 31, 2010.
METHOD OF PRIZE NOTIFICATION
The one (1) Grand Prize winner will be notified by telephone, e-mail or mail by a representative of the Sponsor. The Grand Prize winner will be given seven (7) calendar days from the first time/day of notification to respond to the Sponsor in order to claim the prize. If a potential winner has not responded to the Sponsor within the specified seven (7) days, the potential winner will be disqualified and an alternate may be selected from the pool of eligible entries.
TO CLAIM PRIZE
(a) Winner must provide proof of age, identity and residency; (b) winner must sign and return affidavit of eligibility/compliance with rules, publicity/liability release and indemnification; and (c) winner's intended guest(s) or travel companion(s), if any, must sign liability/publicity release, all within the time period specified by Sponsor.
RESTRICTIONS AND EXCLUSIONS
HOTEL AND PARTNER RESTRICTIONS
Prize package fulfillment is subject to availability and restrictions of the Sponsors and the participating hotel and other prize providers. Travel may not occur during hotel blackout periods that may apply. Contact prize hotel for specific reservations. No extensions on hotel stay. Hotel voucher must be presented upon check-in.
Hotel accommodations must be booked at least fourteen (14) days prior to arrival. Prize package must be completely redeemed by October 31, 2010.
EXCLUSIONS
Items NOT included as part of the winning packages and are the responsibility of the winner include: additional room occupants, meals and sundries, ground transportation, travel insurance, room service, laundry service, spa treatments, alcoholic beverages, local and long-distance telephone calls, merchandise and souvenirs, incidental expenses, additional tips and gratuities, income taxes and all other costs and expenses not otherwise mentioned herein.
OTHER DISCLAIMERS
If an entrant is found to be ineligible, he/she will be disqualified and an alternate winner may be selected from the pool of eligible entries. Prizes are non transferable and must be accepted as awarded. No cash alternative or other substitution allowed. Except where prohibited by law, participation in the Sweepstakes shall constitute an entrant's consent to be bound by these Official Rules and to conform to all federal, state and local laws. The Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value, whether in cash or otherwise, if the prize cannot be awarded as described for any reason.
The Sponsor, in its sole discretion, reserves the right to disqualify any individual who attempts to undermine the legitimate operation of the Sweepstakes by tampering with any web site mechanism, acts in a disruptive manner or violates these Official Rules.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION OF SUCH ENTRANT. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
RELEASES
By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which shall be final in all respects.
By participating in this Sweepstakes, entrants agree to release the Sponsor, its affiliates and partners, their parents, subsidiaries, affiliated and successor companies, advertising and promotion agencies and prize suppliers and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Sweepstakes and/or acceptance or use of the prize.
PERSONAL INFORMATION
Entrants authorize the Released Parties to use their name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, worldwide in perpetuity, or on a winner's list, if applicable, without further compensation unless prohibited by law. Sponsor is not obligated to use any of the above-mentioned information or materials but may do so and may edit such information or materials at Sponsor's sole discretion without further obligation or compensation.
PERSONAL INFORMATION AND PRIVACY POLICIES
The Sponsor will not provide personal information collected via surveys to businesses or organizations for their direct marketing purposes. Information provided for Sweepstakes registration will be used by the Sponsor to notify the winner and award the prize package. The Sponsor may also use contact information for direct marketing purposes.
ARBITRATION/CHOICE OF LAW
Except where prohibited, entrants agree that: (1) any and all disputes, claims and causes of action arising out of or connected with this promotion, the Sweepstakes or any prize awarded, or the determination of the winner, shall be resolved individually, without resort to any form of class action, and exclusively by binding arbitration pursuant to the Rules of the American Arbitration Association, then effective, and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes
but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Pennsylvania, without regard for conflicts of law doctrine, and all proceedings shall take place in the State of Pennsylvania.
